Residency obligation reviews

Residency compliance may be reviewed in a PR-card application, PRTD application, border examination or enforcement process. The permanent resident should answer accurately and understand whether a formal determination is being made.

Identify the decision-maker and stage

IRCC can review the obligation through card and PRTD processing, while CBSA may examine it at entry and prepare an inadmissibility report. Different documents start different response or appeal rights.

Ask for a copy of any report, decision or request.

Prepare a verified travel chronology

Use passports, CBSA history, tickets, addresses and work records to explain each absence. Correct an earlier innocent mistake explicitly rather than repeating it.

Separate physical Canadian days from each category of claimed foreign credit.

Respond to concerns with evidence

If IRCC asks about a relationship, Canadian business or assignment, answer the legal elements with contemporaneous documents. Do not rely on a one-page employer letter where the corporate structure is in issue.

Meet the stated deadline or request additional time with reasons before it expires.

Present humanitarian factors where needed

Explain why the shortfall occurred, Canadian establishment, family impact, return efforts and the best interests of directly affected children. Medical, caregiving or country circumstances need objective support.

A coherent timeline is more persuasive than general hardship language.
