Expired immigration status

A visitor, worker or student whose status expired without a timely extension loses temporary-resident status. Remaining in Canada does not itself extend the document, and late filing does not create maintained status.

Calculate the loss date

Use the permit or visitor record, passport-entry period and any extension decision. A refusal of a timely extension can end maintained status on the decision date.

The visa sticker’s expiry is not necessarily the authorized-stay date.

Stop work or study

Once authorization ends, working or studying normally must stop. Payroll continuation, school permission or a pending late application does not change immigration law.

Keep evidence of the last activity date.

Check the 90-day restoration route

Eligible temporary residents can request restoration within 90 days of losing status if they met the relevant conditions and apply for the proper permit. Restoration is discretionary and does not usually authorize activity while pending.

A person outside the window may need to leave and apply from abroad.

Address family and future applications

Each family member has separate status and deadlines. Spousal sponsorship or another PR application does not automatically legalize the temporary stay.

Disclose the overstay and explain corrective action in later filings.
