Overview

Family class spouse or partner sponsorship

Family Class sponsorship commonly covers a spouse or partner living outside Canada and can also be used in some Canadian cases. The application is still filed through IRCC’s designated process rather than directly at a foreign visa office.

Prove sponsor residence or return plans

A permanent-resident sponsor generally must reside in Canada. A Canadian citizen abroad may sponsor while proving a real plan to return to Canada when the applicant becomes a permanent resident.

Employment searches, housing plans and family arrangements can support the proposed return.

Account for country-specific records

Police certificates, civil-status documents, translations and identity records vary by country. Follow both IRCC’s general instructions and the issuing authority’s process.

Explain unavailable or inconsistent records rather than silently substituting a different document.

Visits do not convert the application

The applicant may separately seek temporary entry and can have dual intent, but must still qualify as a visitor. Coming to Canada during processing does not automatically change the sponsorship class.

Keep IRCC informed of address, marriage, birth and family-composition changes.

A refusal may carry an appeal right

Sponsors of Family Class applicants often have a right of appeal to the Immigration Appeal Division, subject to statutory exclusions. Filing deadlines are short.

The appeal record should be assessed before simply submitting another application.
